Terms and conditions
§ 1 Organiser and acceptance of the conditions of participation
- The competition is organised by METRO AG, Metro-Straße 1, 40235 Düsseldorf, Germany (hereinafter referred to as "METRO" or "Organiser").
- By participating in the competition, the participant accepts the conditions of participation as binding.
§ 2 Prizes
- The winners of the competition will be awarded the following prizes
- First prize: A METRO Professional microwave
- Prizes 2-5: A METRO voucher worth €100
- The prize will be delivered to the winner or his legal representative by post only. The prize cannot be exchanged or paid in cash. The prize is not transferable to third parties. Cash payment or exchange of the prize is excluded.
§ 3 Eligibility
- The competition is open to all METRO customers with permanent residence in Germany who have reached the age of 18.
- if a participant is of limited legal capacity, the consent of his/her legal representative is required.
- it is essential for participation in the competition that all personal details are truthful. The participant is responsible for the accuracy of the data provided.
- employees of METRO and their relatives as well as all persons involved in the design and implementation of the competition are excluded from participation.
- Participation via competition bots, competition services or similar services is not permitted.
§ 4 Exclusion from the competition
- METRO reserves the right to exclude participants from the competition in the event of a breach of these conditions of participation.
- Participants who use inadmissible aids or otherwise obtain advantages through manipulation or attempt to do so will also be excluded. In such cases, prizes may also be subsequently withdrawn and reclaimed.
- If an entrant provides false personal information, this may result in disqualification from the competition.
- If METRO subsequently establishes that a participant has realised a reason for exclusion within the meaning of this paragraph or was not entitled to participate, METRO is entitled to subsequently refuse the prize to the participant concerned and to reclaim it.
§ 5 Implementation and execution of the competition, distribution of prizes
- a person participates in the competition by entering the solution word on MPULSE.de and providing the necessary contact details to the organiser.
- the competition starts on 01 March 2024 and ends on 12 April 2024
- only one entry per entrant will be entered into the competition. It is forbidden to use multiple entries to increase the chances of winning.
- the winner will be drawn at the end of the competition and the prize will be sent by post.
- the right to claim the prize or its replacement is not transferable.
- complaints relating to the organisation of the competition must be sent to METRO in writing within 14 days of becoming aware of the reason for the complaint, citing the competition. Complaints communicated by telephone or delayed complaints will not be processed.
- METRO shall be released from all obligations when the prizes are handed over, unless an earlier date results from these regulations.
§ 6 Early termination of the competition - subject to change
METRO reserves the right to cancel, terminate or modify the competition at any time without prior notice and without giving reasons. METRO will exercise this right in particular if the proper conduct of the competition cannot be guaranteed for technical reasons (e.g. viruses in the computer system, manipulation, errors in the hardware and/or software, blocking of Facebook and abusive behaviour by participants) or for legal reasons. If such a termination is caused by the behaviour of a participant, METRO may demand compensation from this person for the damage incurred. Changes during the course of the competition, in particular by changing the rules or reducing the prize, are not permitted. No claims may be made against the organiser in the event of termination.
§ 7 Data protection
- METRO is responsible for the organisation of the competition and the processing of personal data. The data protection officer of METRO can be contacted at the above contact details and at datenschutz@metro.de.
- In order to participate in the competition and to receive any prizes, participants are asked to provide their first name, last name and address. The participant is under no obligation to provide METRO with his/her personal data, nor is this information required to fulfil any legal or contractual obligation or an obligation to conclude a contract. Failure to provide personal data to METRO shall have no consequences for the participant, except that he/she may not participate in the competition. The legal basis for data processing is Art. 6 par. 1 sentence 1 lit. b) GDPR.
- the personal data will be deleted by us after the end of the competition. During this period, the data will be kept for possible queries regarding the conduct of the competition.

§ 8 Warranty
- METRO must be notified of any obvious defects in the prize within 10 days of receipt of the prize. Timely dispatch of the notification is sufficient to meet the deadline.
- In all other respects, the statutory warranty provisions shall apply to the extent that they are applicable. In the event of a claim for damages, the provisions of Article 9 shall apply.
§ 9 Liability
- METRO shall not be liable for false information that is expressed and disseminated by participants and/or third parties, including any cooperation partners of METRO, in connection with the dissemination of information about the competition.
- METRO does not guarantee that all links and references provided in the context of the competition are correct or complete.
- Furthermore, the liability of METRO and its vicarious agents for breaches of contractual obligations and for tort is limited to intent and gross negligence. This shall not apply in the event of injury to life, body or health of the participant or in the event of claims arising from the breach of cardinal obligations, i.e. obligations which arise from the nature of the contract and the breach of which jeopardises the achievement of the purpose of the contract.
- the above limitation of liability applies in particular to damage caused by errors, delays or interruptions in the transmission of data or similar, faults in the technical systems or the service, incorrect content, loss or deletion of data, viruses.
§ 10 Miscellaneous
- Legal recourse is excluded.
- The law of the Federal Republic of Germany applies exclusively.
- Should any of these provisions be or become invalid, this shall not affect the validity of the remaining terms and conditions.
- any deviations from these terms and conditions must be made in writing to be valid. The same applies to any waiver of the written form requirement.
- The place of performance and jurisdiction shall be Düsseldorf, Germany, to the extent that such an agreement is permissible. Otherwise, the registered office or place of residence of the defendant shall apply.
